PATENTS

Picture
Patents give the owner of an invention the exclusive right to exploit and protect that invention. It is the certificate that a country awards to the owner of that invention, lasting fourteen (14) years.

For a patent to be valid for consideration and approval, the invention must fit three (3) criteria:
  1. Industrial Applicability: the invention must be capable of being produced and used at an industrial level
  2. Novelty: the invention cannot be registered if a similar invention already exists
  3. Inventive Step & Non-Obviousness: The invention cannot be familiar to experts in the industry before it has been patented
Anyone, whether a Grenadian citizen or British subject or not, can make an application for a patent. Two or more persons may submit a joint application for a patent, which may be granted to them jointly, whether either party is the inventor of the invention or not. The applicant must have a postal address in Grenada to which any notice and communication may be addressed.
